STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT relative to insurance records required for market conduct purposes.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Market Conduct Record Retention and Production; Records Required for Market Conduct Purposes. Amend RSA 400-B:3 by inserting after paragraph I the following new paragraph:
I-a. An insurer that requires, by contract or other means, a related entity or other person authorized to act on its behalf in connection with the doing of insurance business to maintain records that the insurer would otherwise be required to maintain shall be responsible if the related entity or other person either fails or is unable to maintain the records in the required manner.
2 Effective Date. This act shall take effect 60 days after its passage.
