HOUSE BILL 508

AN ACT relative to ex parte hearings.

ANALYSIS

This bill states that no ex parte hearing shall be held when a party’s civil rights or civil liberties are at stake, unless all possible attempts have been made to notify the party of the hearing.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to ex parte hearings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Ex Parte Hearings; Notice Requirement. Amend RSA 514 by inserting after section 14 the following new section:

514:14-a Ex Parte Hearings; Notice. No ex parte hearing shall be held when a party’s civil rights or civil liberties are at stake, unless all possible attempts have been made to provide notice of the hearing to the party.

2 Effective Date. This act shall take effect January 1, 2006.
