AN ACT prohibiting dogs from being left alone in cars.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT prohibiting dogs from being left alone in cars.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Unattended Dogs in Motor Vehicles. Amend RSA 466 by inserting after section 45 the following new section:
466:45-a Unattended Dogs in Motor Vehicles; Penalty.
I. A person shall not leave a dog unattended in a standing or parked motor vehicle in a manner that endangers the dog’s health or safety.
II. A law enforcement officer, animal control officer, an agent of a duly licensed humane society, or a volunteer or professional member of a fire or rescue department of a political subdivision may use reasonable force to enter a motor vehicle and remove a dog which has been left in the vehicle in violation of paragraph I. A person removing a dog under this section shall use reasonable means to contact the owner of the dog to arrange for its return home. If the person is unable to contact the owner, the person may take the dog to an animal shelter.
III. Any person who violates the provisions of paragraph I shall be guilty of a violation.
2 Effective Date. This act shall take effect January 1, 2007.
