HOUSE BILL 162
AN ACT relative to liability for costs, fees, and certain expenses incurred by a defendant where the court finds the defendant’s conduct is justifiable.
ANALYSIS
This bill provides that the court shall award reasonable attorney’s fees, court costs, compensation for loss of income, compensation for loss of assets, and any other expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant’s conduct is justifiable.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to liability for costs, fees, and certain expenses incurred by a defendant where the court finds the defendant’s conduct is justifiable.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Justification; General Rule. Amend RSA 627:1 to read as follows:
627:1 General Rule.
I. Conduct which is justifiable under this chapter constitutes a defense to any offense. The fact that such conduct is justifiable shall constitute a complete defense to any civil action based on such conduct.
II. The court shall award reasonable attorney’s fees, court costs, compensation for loss of income, compensation for loss of assets, and any other expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant’s conduct is justifiable.
2 Effective Date. This act shall take effect January 1, 2008.
