AN ACT relative to possessory actions against tenants.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to possessory actions against tenants.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Possessory Action Against Tenants. RSA 540:12 is repealed and reenacted to read as follows:
540:12 Possessory Actions.
I. The lessor of any tenement or real estate may recover possession thereof from a lessee after the service of an eviction notice as prescribed in this chapter.
II. The owner of any tenement or real estate may recover possession thereof from an occupant other than a lessee by an action of ejectment pursuant to RSA 509:6.
III. The purchaser at a mortgage foreclosure sale of any tenement or real estate may recover possession thereof from the mortgagor by filing with the court a certified copy of the recorded foreclosure deed, upon which a writ of possession shall be issued forthwith without notice to the mortgagor.
2 Effective Date. This act shall take effect January 1, 2008.
