STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to the sale of class A sludge in bulk agricultural fertilizer bags.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Sale of Class A Sludge. Amend RSA 431 by inserting after section 35 the following new section:
431:35-a Sale of Class A Sludge.
I. Class A sludge may be sold or distributed in New Hampshire, provided that the product is packaged in a 2000 pound bulk agricultural fertilizer bag.
II. In this section, “bulk agricultural fertilizer bag” means a large plastic or fabric agricultural fertilizer bag with a large opening at the bottom. Fertilizer bags shall meet all federal and state requirements of the state from which the bag is sent.
2 Sludge Handling Added. Amend the subdivision heading preceding RSA 431:33 to read as follows:
Manure, Agricultural Compost,
[and] Chemical Fertilizer, and Sludge Handling
3 Effective Date. This act shall take effect 60 days after its passage.
