STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to maintenance of grounds around signs in the right-of-way on state highways.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Maintenance of Grounds. Amend RSA 236:88-a by inserting after paragraph IV the following new paragraph:
IV-a. The department of transportation shall maintain such signs as needed to keep a clear view of the sign and a clear right-of-way. All businesses owning signs on state highways shall pay the department of transportation $500 per year for grounds maintenance.
2 Effective Date. This act shall take effect July 1, 2007.

SB 122 FISCAL NOTE
AN ACT relative to maintenance of grounds around signs in the right-of-way on state highways.
FISCAL IMPACT:
The Department of Transportation has determined this bill may have an indeterminable fiscal impact on highway fund revenue and expenditures in fiscal year 2008 and each year thereafter. There is no fiscal impact on county and local revenues or expenditures.
METHODOLOGY:
The Department of Transportation states this bill allows it to charge all businesses that own signs within the right-of-way of state highways a sum of $500 per year to maintain the state right-of-way such that a view of the sign and a clear right-of-way exists. The fiscal impact on highway fund revenue and expenditures cannot be determined due to the continually changing number of signs within the state right-of-way as well as the variable cost to clear along the right-of-way adjacent to businesses due to inconsistent roadway frontage distances and right-of-way widths.
