HOUSE BILL 1269

AN ACT authorizing local governing bodies to place certain properties on a conservation priority list and requiring owners of land designated as conservation priority land to notify the municipality before offering the land for sale.

ANALYSIS

This bill:

I. Gives local governing bodies the authority to place certain properties on a conservation priority list.

II. Requires owners of property on the conservation priority list to send notification to the local governing body 60 days before offering the property for sale.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT authorizing local governing bodies to place certain properties on a conservation priority list and requiring owners of land designated as conservation priority land to notify the municipality before offering the land for sale.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Local Option for Conservation Priority Land. Amend RSA 674 by inserting after section 21-a the following new section:

674:21-b Local Option for Conservation Priority Land.

I. The local governing body shall request a consultation with the local conservation commission established in RSA 36-A in order to identify property within the municipality which is of importance to local conservation efforts.

II. The local governing board, at the annual meeting, shall vote on properties identified with the counsel of the conservation commission, placing those receiving a majority affirmative vote on the municipality’s conservation priority list.

III. The owners of properties placed on the municipality’s conservation priority list shall receive notice from the local governing body within 60 business days of the annual meeting. Such notification shall state that the property is listed as a conservation priority. Such notification shall also inform the property owner that should the property owner wish to sell the property, the property owner shall send notification of intent to sell the property to the local governing body at least 60 days before offering the property for sale.

2 Effective Date. This act shall take effect 60 days after its passage.
