AN ACT relative to burials in cemeteries.

This bill prohibits cemeteries from refusing to bury bodies based on lack of embalming or the type of casket or container in which the body is to be buried.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to burials in cemeteries.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Cemeteries; Natural Burials. Amend RSA 289 by inserting after section 2 the following new section:
289:2-a Natural Burials. No cemetery shall refuse to bury a body because it is not embalmed or based on the type of casket or container in which the body is to be buried. Any person who violates the provisions of this section shall be guilty of a misdemeanor.
2 Embalmers; Exception Added. Amend RSA 325:40-a to read as follows:
325:40-a Deceased Human Bodies Exposed. Except as provided in RSA 289:2-a, no dead human body shall be exposed to the public for a period in excess of 24 hours unless said body is properly embalmed.
3 Effective Date. This act shall take effect January 1, 2009.
