AN ACT relative to notice of video or audio surveillance in a business or public building.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to notice of video or audio surveillance in a business or public building.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraphs; Wiretapping and Eavesdropping; Exceptions. Amend RSA 570-A:2, II by inserting after subparagraph (k) the following new subparagraphs:

(l) The state or any agency, department, board, commission, or political subdivision thereof, to conduct audio or video surveillance, or both, at a public building to record individuals entering and exiting the building, provided that a sign at least one square foot in size, giving notice that surveillance is occurring, is posted at each entrance and exit within 6 feet of each audio or video recording device.

(m) A private business owner to conduct audio or video surveillance, or both, at a business location to record individuals entering and exiting the building, provided that a sign at least one square foot in size, giving notice that surveillance is occurring, is posted at each entrance and exit within 6 feet of each audio or video recording device.

2 Effective Date. This act shall take effect 60 days after its passage.
