SENATE BILL 165-FN
AN ACT relative to informing physicians of results of the screening panels for medical injury claims.
ANALYSIS
This bill requires the administrative office of the courts to report to the board of medicine information concerning screening panels on medical injury claims, and requires the board of medicine to provide at least annually an executive summary of the results of screening panels to licensed physicians.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to informing physicians of results of the screening panels for medical injury claims.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Board of Medicine; Screening Panel Results. Amend RSA 329 by inserting after section 8 the following new section:
329:8-a Screening Panel Results; Information to Physicians.
I. The board shall, at least annually, compile an executive summary of the results of the screening panels on medical injury claims derived from the report to the board required under RSA 519-B:12, I-a. The executive summary shall be designed to provide physicians licensed by the board information on medical injury claims and problems in the practice of medicine generally.
II. The executive summary of screening panel results shall be mailed at least once each year to all physicians licensed by the board.
2 New Paragraph; Screening Panels on Medical Injury Claims; Duty of Administrative Office of Courts. Amend RSA 519-B:12 by inserting after paragraph I the following new paragraph:
I-a.(a) The administrative office of the courts shall collect data on medical injury claims and submit a report to the board of medicine, established in RSA 329, on or before September 30 of each year.
(b) The report required by this paragraph shall include the number of medical injury cases filed, pending, and resolved; and the number of panel hearings and the number of panel hearing days during the fiscal year ending on the June 30 preceding the report date.
(c) The report required by this paragraph shall also include, for medical injury cases resolved during the fiscal year, information on the screening panel results containing:
(1) A description of the basis for all meritorious and non-meritorious claims.
(2) A list of the type of negligence or other causation for each claim, and the evidence related to such claim, as determined in the findings of screening panels under RSA 519-B:6.
(3) The number and average settlement amount of cases that were resolved after a panel hearing but before a trial.
(4) The number and average settlement amount of cases that were resolved by or after a jury verdict.
(d) Any information provided under this paragraph shall not include the name or other identifying information of any person involved as party, counsel, witness, or screening panel member. The report required in this paragraph shall not compromise the confidentiality or privilege under RSA 519-B:8.
3 Effective Date. This act shall take effect 60 days after its passage.
