SENATE BILL 369
AN ACT relative to the towing and storage of motor vehicles.
ANALYSIS
This bill makes it an unfair and deceptive insurance practice for an insurer to unreasonably refuse payment of storage or towing claims for damage to an insured’s motor vehicle under the insured’s physical damage coverage or property damage liability coverage.
This bill is a request of the insurance department.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to the towing and storage of motor vehicles.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Unfair Insurance Practices; Storage and Towing of Motor Vehicles. Amend RSA 417:4 by inserting after paragraph XXII the following new paragraph:
XXIII. STORAGE AND TOWING OF MOTOR VEHICLES. Unreasonably refusing payment of storage or towing claims for the damage to an insured’s motor vehicle under the insured’s physical damage coverage, or to a claimant’s motor vehicle under property damage liability coverage; provided, however, the insurance company may at its cost, move the motor vehicle to a storage facility of the insurer’s choosing to reduce or eliminate storage charges.
2 Effective Date. This act shall take effect January 1, 2009.
