AN ACT relative to mail-in rebates for merchandise purchased within the state.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to mail-in rebates for merchandise purchased within the state.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Chapter; Rebates. Amend RSA by inserting after chapter 358-S the following new chapter:
CHAPTER 358-T
REBATES
358-T:1 Rebates. For all retail transactions conducted within the state:
I. A rebate offered directly by a retailer on a product the retailer sells shall be redeemed at the time of the product’s purchase.
II. A rebate offered by a manufacturer or other entity on a product the retailer sells shall be redeemed by the retailer at the time of the product’s purchase, and the manufacturer or other entity offering the rebate shall reimburse the retailer.
III. The failure of a retailer to redeem a rebate under paragraph I or II shall constitute an unfair or deceptive act or practice under RSA 358-A:2 and the consumer may bring a private action against the retailer under RSA 358-A:10.
IV. The failure of a manufacturer or other entity to reimburse a retailer for a redeemed rebate under paragraph II shall constitute an unfair or deceptive act or practice under RSA 358-A:2 and the retailer may bring a private action against the manufacturer or other entity under RSA 358-A:10.
2 Effective Date. This act shall take effect January 1, 2009.
