AN ACT establishing a penalty for destruction or frustration of an easement of access.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a penalty for destruction or frustration of an easement of access.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Destruction of Easement of Access; Violation. Amend RSA 477 by inserting after section 52 the following new subdivision:

Destruction of Easement of Access

477:53 Destruction of Easement of Access; Violation. Any owner of a servient estate who refuses to remedy a condition on his or her property that causes a destruction or frustration of an easement of access shall be guilty of a violation.

2 Effective Date. This act shall take effect January 1, 2010.
