STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to fences as private nuisances.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fences; Private Nuisance. Amend RSA 476:1 to read as follows:

476:1 Fence as Private Nuisance. Any fence or other structure in the nature of a fence, unnecessarily exceeding [5] 6 feet in height, erected or maintained for the purpose of annoying the owners or occupants of adjoining property shall be deemed a private nuisance.

2 Effective Date. This act shall take effect 60 days after its passage.
