AN ACT relative to transporting medical records.

ANALYSIS

This bill requires any medical records which are being disposed of and transported to a different location to be shredded before they are transported.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to transporting medical records.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Disposal of Medical Records. Amend RSA 332-I by inserting after section 2 the following new section:

332-I:3 Disposal of Medical Records. Any person transporting medical records for disposal shall shred such records before they are transported. Whoever violates the provisions of this section shall be guilty of a violation if a natural person, or guilty of a misdemeanor if any other person.

2 Effective Date. This act shall take effect upon its passage.
