AN ACT relative to taking stones from stone walls.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to taking stones from stone walls.

Be it Enacted by the Senate and House of Representatives in General Court convened:

294:1 Willful Trespass; Stone. Amend RSA 539:4 to read as follows:

539:4 Stone, etc. Whoever shall willfully and unlawfully dig or carry away any stone, including stone from a stone wall, ore, gravel, clay, sand, turf, [or] mold, or loam upon or from land holden in common or from the land of another person, or shall aid therein, shall forfeit to the person injured treble damages[, and not more than fifteen dollars] based on the cost of materials and restoration, and including attorney’s fees and costs.

294:2 Effective Date. This act shall take effect 60 days after its passage.
