STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to lake and pond preservation and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation. The sum of $1,000,000 to the department of environmental services for the fiscal year ending June 30, 2009 is hereby appropriated to the special nonlapsing account established under RSA 487:25, I in the lake restoration and preservation fund to administer the milfoil and other exotic aquatic plants prevention program. This appropriation shall be a charge against the land and community heritage investment program.

2 Effective Date. This act shall take effect upon its passage.

SB 162-FN-A - FISCAL NOTE

AN ACT relative to lake and pond preservation and making an appropriation therefor.

FISCAL IMPACT:

The Department of Environmental Services states this bill will increase state restricted revenue by $1,000,000 in FY 2009 and state restricted expenditures by $250,000 in FY 2010, $375,000 in FY2011 and $375,000 in FY 2012. The Department also states this bill may increase state restricted and local revenue by indeterminable amount in FY 2011 and FY 2012. This bill will have no fiscal impact on county revenue or county and local expenditures.

This bill appropriates $1,000,000 in FY 2009 from the Land and Community Heritage Investment Program to the Department of Environmental Services for the purposes of this act.

METHODOLOGY:

The Department of Environmental Services states this bill makes an appropriation from the Land and Community Heritage Investment Program (LCHIP) to the Lake Restoration and Preservation fund, a special nonlapsing account, to eradicate milfoil. The Department states the funds will be expended over the course of three years with $250,000 allocated to control efforts performed by the Department in FY 2010 and $375,000 allocated in FY 2011 and FY 2012 for exotic weed control grants to municipalities, lake and river associations and other state agencies.

The Land and Community Heritage Investment Program states this bill appropriates $1,000,000 from the LCHIP trust fund held by the State Treasury to the Department of Environmental Services. LCHIP is obligated to repay $3 million of its FY 2008 general fund appropriation in June 2009 per Executive Order 2008-10. LCHIP plans to repay the $3 million of general funds from the estimated $3 million in revenue LCHIP expects to receive in FY 2009 from the $25 surcharge on mortgage documents, which may leave the program with no funds for new projects in FY 2009.
