AN ACT relative to the cost of lodging of persons sentenced to a county correctional facility.

ANALYSIS

This bill removes the requirement that the state pay the cost of lodging of persons sentenced to a county correctional facility for more than one year.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the cost of lodging of persons sentenced to a county correctional facility.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 County Department of Corrections; Expenses of Custody. Amend RSA 30-B:15 to read as follows:

30-B:15 Place of Commitment; Expense of Protective Custody.

[I.] For any person sentenced to a term of imprisonment [of up to 12 months], the expense of lodging such person in a county correctional facility shall be a charge upon the county in which the offense was committed. [For persons sentenced to terms of imprisonment in a county correctional facility that exceed 12 months, the first 12-month sentence shall be a charge upon the county. Any sentence exceeding 12 months of imprisonment shall be a charge upon the state.

II. Whenever the expense of lodging a person in a county correctional facility is to be a charge against the state under this section, the state shall have the authority to take physical custody of such person.]

2 Effective Date. This act shall take effect upon its passage.

SB 177 FISCAL NOTE

AN ACT relative to the cost of lodging of persons sentenced to a county correctional facility.

FISCAL IMPACT:

The Department of Corrections and New Hampshire Association of Counties state this bill will decrease state general fund expenditures and county revenue and increase county expenditures by an indeterminable amount in FY 2009 and each year thereafter. There is no fiscal impact on local expenditures or state and local revenue.

METHODOLOGY:

The Department of Corrections states this bill will remove the requirement that the state pay the cost of lodging of persons sentenced to a county correctional facility for more than one year. The Department states only one county is billing the Department for persons in a county correctional facility for more than one year. The Department states during FY 2008 the county submitted bills in excess of $55,000. The Department states this bill will decrease state general fund expenditures by an indeterminable amount in FY 2009 and each year thereafter.

The New Hampshire Association of Counties states it is not able to determine the number of individuals sentenced to longer than 12 months or the length of the sentences. To the extent individuals are sentenced for more than one year in the county correctional facility, the Association states the county expenditures will increase and county revenue will decrease by an indeterminable amount. The Association states the average annual cost of incarceration in a county correctional facility is $30,165.
