STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to government immunity from lawsuits for municipal dog parks.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Municipal Liability Limited; Municipal Dog Parks. Amend RSA 507-B by inserting after section 11 the following new section:
507-B:12 Use of Municipal Dog Park Facilities. A municipality or authorized agent of the municipality which, without charge, permits any person to use a facility operated by the municipality for the purpose of exercising or playing with his or her dog or dogs, shall not be liable for personal injury or property damage resulting from the person’s participation in such activity, in the absence of gross negligence.
2 Effective Date. This act shall take effect 60 days after its passage.
