HOUSE BILL 1342
AN ACT relative to the right of election to submit a claim for medical expenses under a medical payments motor vehicle liability policy or a health insurance policy.
ANALYSIS
This bill requires medical care providers to inform an insured of the right of election in the submission of claims for medical coverage and denies payment for medical services until the limit of insurance is exhausted.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to the right of election to submit a claim for medical expenses under a medical payments motor vehicle liability policy or a health insurance policy.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Medical Payments. Amend RSA 264:16, IV to read as follows:
IV. The insured shall have the exclusive right to submit a claim for medical expenses under either medical payments coverage or a health insurance policy or both, as the insured elects; provided, however, an insured shall not be entitled to duplicate payment from medical payments coverage and a health insurance policy for the same medical expense. Medical care providers, as defined in RSA 507-C:1, II, shall inform the insured or his or her family or legal representative of such right of election and shall be ineligible for payment for its services until the limit of the insurance elected by the insured is exhausted.
2 Effective Date. This act shall take effect 60 days after its passage.
