SENATE BILL 304
AN ACT relative to the return of outdated drugs.
ANALYSIS
This bill requires drug manufacturers and wholesalers licensed by the pharmacy board to have adequate provisions for the return of outdated drugs for up to 6 months after expiration.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to the return of outdated drugs.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Pharmacies; Licensing of Manufacturers and Wholesalers; Return of Outdated Drugs. Amend RSA 318:51-a by inserting after paragraph III the following new paragraph:
III-a. A licensed manufacturer or wholesaler shall have adequate provisions for the return of outdated drugs in both full and partial containers. Drugs shall be returnable to the manufacturer or wholesaler for up to 6 months after the labeled expiration date for prompt full credit or replacement. A finding by the board that a manufacturer or wholesaler is not in compliance with this standard shall cause that manufacturer’s or wholesaler’s products to be ineligible for use in product selection.
2 Effective Date. This act shall take effect 60 days after its passage.
