STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT revising the child support guidelines based on foster care reimbursement rates.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Definition of Total Support Obligation. Amend RSA 458-C:2, XI to read as follows:
XI. “Total support obligation” means either net income multiplied by the appropriate percentage derived from RSA 458-C:3 or the applicable state foster care reimbursement rate, whichever is less.
2 Child Support Formula; Use of Foster Care Reimbursement Rates. RSA 458-C:3, II(a) is repealed and reenacted to read as follows:
(a) The total support obligation shall be equal to the applicable state foster care reimbursement rate, taking into account the age and special needs of each child for whom support is being calculated, or the parents’ total net income, as defined in RSA 458-C:2, VI, multiplied by the appropriate percentage derived from paragraph I, whichever is less.
3 Applicability. The amendment of RSA 458-C:2 and RSA 458-C:3 as provided in sections 1 and 2 of this act shall be considered a substantial change in circumstances for purposes of RSA 458-C:7.
4 Effective Date. This act shall take effect 60 days after its passage.
