AN ACT relative to the closure of certain underground storage tank systems.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to the closure of certain underground storage tank systems.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Underground Storage Tank Systems; Permanent Closure Waiver. Amend RSA 146-C by inserting after section 9-a the following new section:
146-C:9-b Underground Storage Tank Systems; Permanent Closure Waiver. The requirement of New Hampshire code of administrative rules Env-Wm 1401.18(c) that any part of an existing single wall underground storage tank system that routinely contains regulated substance without secondary containment and leak monitoring shall be permanently closed by December 22, 2015 is hereby waived for those tanks that have:
(a) Annual vacuum tests for structural integrity.
(b) $1,000,000 of liability insurance for costs of cleanup and restoration of the site and surrounding environment.
2 New Paragraph; Rulemaking. Amend RSA 146-C:9 by inserting after paragraph XIII the following new paragraph:
XIV. Procedures, forms, and information required for vacuum testing, as authorized by RSA 146-C:9-b.
3 Effective Date. This act shall take effect 60 days after its passage.
