HOUSE BILL 1261

AN ACT relative to recovery of delinquent condominium fees.

ANALYSIS

This bill permits a condominium unit owners’ association to file multiple liens for unpaid condominium fees. The bill also removes the grandfathering provision for mortgages executed prior to January 1, 2011.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to recovery of delinquent condominium fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Condominium Act; Lien for Assessments. RSA 356-B:46, I(d) is repealed and reenacted to read as follows:

(d) Nothing in this section shall preclude the unit owners’ association from filing more than one lien under subparagraph (c); nor shall the priority lien rights established under subparagraph (c) be limited by the mortgage execution date.

2 Effective Date. This act shall take effect January 1, 2013.
