AN ACT relative to advance directives pertaining to medically administered nutrition and hydration.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to advance directives pertaining to medically administered nutrition and hydration.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Advance Directives; Medically Administered Nutrition and Hydration. RSA 137-J:20, I, B. is repealed and reenacted to read as follows:
B. MEDICALLY ADMINISTERED NUTRITION AND HYDRATION.
1. If I am near death and lack the capacity to make health care decisions. I authorize my agent to direct that:
(Initial beside your choice of (a) or (b).)
(a) medically administered nutrition not be started or, if started be discontinued.
or
(b) even if all other forms of life-sustaining treatment have been withdrawn, medically administered nutrition continue to be given to me.
2. If I am near death and lack the capacity to make health care decisions. I authorize my agent to direct that:
(Initial beside your choice of (a) or (b).)
(a) medically administered hydration not be started or, if started be discontinued.
or
(b) even if all other forms of life-sustaining treatment have been withdrawn, medically administered hydration continue to be given to me.
(If you fail to complete item B, your agent will not have the power to direct the withholding or withdrawal of medically administered nutrition and hydration.)
2 Effective Date. This act shall take effect January 1, 2013.
