HOUSE BILL 1601

AN ACT relative to the notice to defendant in small claims actions.

ANALYSIS

This bill requires the plaintiff in a small claims action to complete service on a defendant at the expense of the plaintiff when the defendant fails to respond to the notice and the notice is not returned as undeliverable within 30 days of the mailing of the notice by the court.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the notice to defendant in small claims actions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Small Claims Actions; Notice to Defendant. RSA 503:6, II is repealed and reenacted to read as follows:

II. If the defendant fails to respond to the notice and the notice is not returned as undelivered within 30 days from the date the notice is mailed, then the court shall direct the plaintiff to complete service on the defendant, at the expense of the plaintiff, as in all other actions at law.

2 Effective Date. This act shall take effect January 1, 2013.
