HOUSE BILL 1639
AN ACT relative to employment of certain disability retirees by retirement system employers.
ANALYSIS
This bill prohibits a disability retiree on total disability pursuant to the provisions of RSA 100-A from being employed in a similar job classification.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to employment of certain disability retirees by retirement system employers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Disability Retirement; Similar Employment Prohibited. Amend RSA 100-A by inserting after section 6-a the following new section:
100-A:6-b Disability Retirement; Similar Employment Prohibited. Notwithstanding RSA 100-A:6, III(b), no disability retiree who is totally and permanently incapacitated may be employed by an employer in a full or part-time position with the same job classification as the disability retiree held at the time of disability.
2 Effective Date. This act shall take effect 60 days after its passage.
