STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to claiming an invasive species as a habitat.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Endangered Species Conservation Act; Exemptions and Restrictions. Amend RSA 212-A:13 by inserting after paragraph III the following new paragraph:
IV. No provision of RSA 212-A nor rule adopted under this chapter shall claim an invasive species as a habitat for an endangered species.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 439 FISCAL NOTE
AN ACT relative to claiming an invasive species as a habitat.
FISCAL IMPACT:
The New Hampshire Fish and Game Department states this bill will have an indeterminable impact on state revenue and expenditures. There is no fiscal impact on county or local revenue or expenditures.
METHODOLOGY:
The New Hampshire Fish and Game Department states this bill prohibits invasive species from being claimed as a habitat for endangered species. The Department states there are terrestrial and aquatic endangered species found in habitats containing aquatic or terrestrial invasive plants, but it cannot determine the fiscal impact such a prohibition would have.
The Departments of Environmental Services and Agriculture state this bill will have no impact on the Departments.
