STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to the installation of municipal culverts.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Excavating and Dredging Permit; Certain Exemptions; Use of Best Management Practices. RSA 482-A:3, XVI(a) is repealed and reenacted to read as follows:
XVI.(a) Any municipality that has a professional engineer ensure that best management practices for routine roadway maintenance in New Hampshire published by the department of transportation are followed by its employees or contractors who install, repair, or replace culverts or stream crossing structures, including culverts up to and including 48 inches in diameter or the functional hydraulic equivalent, and that files an appropriate notice under subparagraph (b) shall be exempt from the permitting requirement of RSA 482-A:3, I(a).
2 Effective Date. This act shall take effect 60 days after its passage.
