HOUSE BILL 452

AN ACT relative to Food and Drug Administration approval of medication, equipment, and therapies.

ANALYSIS

This bill authorizes heath care facilities and physicians to dispense medication and use equipment and therapies which are not Food and Drug Administration approved.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to Food and Drug Administration approval of medication, equipment, and therapies.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Food and Drug Administration Approval Not Required. Amend RSA 151 by inserting after section 12-b the following new section:

151:12-c Food and Drug Administration Approval Not Required. A facility required to be licensed under this chapter may dispense medication and use equipment and therapies which are not approved by the federal Food and Drug Administration.

2 New Section; Food and Drug Administration Approval Not Required. Amend RSA 329 by inserting after section 31 the following new section:

329:31-a Food and Drug Administration Approval Not Required. A physician required to be licensed under this chapter may dispense medication and use equipment and therapies which are not approved by the federal Food and Drug Administration.

3 Effective Date. This act shall take effect upon its passage.
