AN ACT relative to the proposed Sewalls Falls Bridge in the city of Concord and the Riverdale Road Bridge in the town of New Boston.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT relative to the proposed Sewalls Falls Bridge in the city of Concord and the Riverdale Road Bridge in the town of New Boston.
Be it Enacted by the Senate and House of Representatives in General Court convened:
233:1 Findings. The general court hereby affirms its long-term commitment to preserving the natural beauty, landscape, rural character, and natural resources of New Hampshire consistent with the enabling legislation of the land conservation investment program. The general court, however, recognizes in this specific instance, in the interest of public safety and welfare, that transfer of interest in 0.22 acres as well as a temporary transfer of 0.22 acres for construction of the Sewalls Falls Bridge of protected lands to the City of Concord is necessary to reconstruct the bridge to current standards. The impacted areas run along the edge of existing roads and have been designed to minimize the environmental impact so as not to impair the conservation values for which the original conservation lands were acquired. Therefore, the general court hereby finds that in this instance, section 2 of this act balances the public purposes of providing safe travel along Sewalls Falls Road with the need to ensure that the public’s investment in conservation lands is not diminished over time.
233:2 Certain Land in the City of Concord, New Hampshire. Notwithstanding any other law to the contrary, interest in an approximately 0.22 acre portion of land along Sewalls Falls Road, acquired by the state under the land conservation investment program, shall be transferred to the city of Concord for the purpose of reconstructing the Sewalls Falls Bridge. The city shall also be authorized to temporarily encumber an approximately 0.22 additional acre of land along Sewalls Falls Road throughout the construction phase of the Sewalls Falls Bridge. Compensation due to the state shall be the full fair market value of those property interests at the time of conveyance as determined by the city of Concord assessing department, in consultation with the office of energy and planning. Alternative forms of compensation such as replacement land with comparable conservation value, or a combination of monetary compensation and replacement land may be considered provided all parties owning an interest in the property agree to such terms. Any monetary compensation due to the state under this section shall be deposited in the land conservation endowment fund administered by the council on resources and development pursuant to RSA 162-C:7 and used for the purposes of the land conservation investment program.
233:3 Findings.
