STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to violations of constitutional rights.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Corrupt Practices; Trespass on Constitutional Rights. Amend RSA 539 by inserting after section 9 the following new section:

539:10 Trespass on Constitutional Rights. Whoever, acting under color of law or otherwise uses or attempts to use threats, duress, intimidation, or coercion to diminish any inhabitant’s constitutional rights or privileges shall be guilty of a misdeed and trespass. Upon receipt of an inhabitant’s affidavit of complaint of trespass the county attorney shall immediately bring a civil action for injunctive or other appropriate relief in the name of the state of New Hampshire.

2 Effective Date. This act shall take effect January 1, 2016.
