ANALYSIS

This bill requires the court in parenting cases to inform the parties that intentional false statements may be subject to criminal prosecution. The bill also provides that if the court is presented with evidence of perjury, the court shall refer the matter to the county attorney.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to acts of falsification in family law cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Parental Rights and Responsibilities; False Statements. Amend RSA 461-A by inserting after section 15 the following new section:

461-A:15-a False Statements. In any proceeding under this chapter, the court shall inform the parties that any person who makes a false statement or representation to the court and who does not believe the statement or representation to be true may be subject to prosecution and punishment for perjury under RSA 641:1, false swearing under RSA 641:2, or unsworn falsification under RSA 641:3. If the court is presented with evidence that a crime under RSA 641 has occurred, the court shall refer the matter to the county attorney for further investigation and prosecution.

2 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to acts of falsification in family law cases.

FISCAL IMPACT:

The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill, as introduced, as it is awaiting information from the Department of Corrections and New Hampshire Associations of Counties, who were contacted on 12/30/14. When completed, the fiscal note will be forwarded to the House Clerk's Office.
