STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT relative to open access to broadband infrastructure.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Broadband Access. Amend RSA 38:38 by inserting after paragraph II the following new paragraph:
III. A municipality shall permit broadband Internet service providers to install cable or fiber optic lines along existing roads, highways, bridges, telephone poles, water, or sewer lines. No municipality shall charge such broadband Internet service provider more that the cost of installation and maintenance of such lines.
2 Effective Date. This act shall take effect 60 days after its passage.
