AN ACT relative to assignment or transfer of an operating permit issued by the department of environmental services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Sixteen

AN ACT relative to assignment or transfer of an operating permit issued by the department of environmental services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Criteria for Denial; Suspension or Revocation; Modification; Transfer. Amend the section heading of RSA 125-C:13 to read as follows:

125-C:13 Criteria for Denial; Suspension or Revocation; Modification; Transfer.

2 New Paragraph; Criteria for Denial; Suspension or Revocation; Modification; Transfer. Amend RSA 125-C:13 by inserting after paragraph IV the following new paragraph:

V. The commissioner may transfer a permit or authorization to a successor in interest to the person originally granted such permit or authorization if the commissioner determines that there have been no material changes to the device or non-Title V source since the issue of such permit or authorization.

3 Effective Date. This act shall take effect 60 days after its passage.
