STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT relative to controlled drug prescription health and safety information.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Controlled Drug Prescription Health and Safety; Definitions. Amend RSA 318-B:31 by inserting after paragraph IX the following new paragraph:
X. "Law enforcement official" shall have the same meaning as in RSA 318-B:1, XIV-a.
2 Controlled Drug Prescription Health and Safety Program. Amend RSA 318-B:35, I(b)(3) to read as follows:
(3) Authorized law enforcement officials on a case-by-case basis for the purpose of investigation and prosecution of a criminal offense [when presented with a court order based on probable cause. No law enforcement agency or official shall have direct access to the program] pursuant to the following sections: RSA 318-B:2, V-VI; RSA 318-B:2, VIII; RSA 318-B:2, X; RSA 318-B:2, XII-a; RSA 318-B:21; or RSA 318-B:25. For the purpose of investigation and prosecution of a criminal offense under any other provision of RSA 318-B, law enforcement officials may receive information contained in the prescription health and safety program upon presentment of a court order based on probable cause. No law enforcement agency or official shall have direct access to the program or its database.
3 Effective Date. This act shall take effect January 1, 2017.
