STATE OF NEW HAMPSHIRE

AN ACT relative to certification for solid waste operators.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Certificates for Solid Waste Operators; Volunteers and Part Time Workers Exempt. Amend RSA 149-M:6, XIII to read as follows:

XIII. Establish and administer a certification program for solid waste operators which shall include training courses, and may include testing. The fee for certification shall not exceed $50 per attendee, and shall be deposited in the nonlapsing revolving fund established in RSA 21-O:1-a. Certification shall be renewed annually. If the renewal fee is not submitted within 90 days after the certificate's expiration date, the certified individual's name shall be removed from the current status and the certification shall be deemed expired. The department shall charge a late fee of 50 percent of the renewal fee in addition to the renewal fee if the renewal is received after the certificate's expiration date. Volunteers and solid waste operators working fewer than 40 hours a week who are under the direct supervision of personnel certified pursuant to this chapter shall be exempt from the certification requirement of this paragraph.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1440-FN- FISCAL NOTE

AN ACT relative to certification for solid waste operators.

FISCAL IMPACT:

The Department of Environmental Services states this bill, as introduced, will decrease state restricted revenue and expenditures by $50,000 in FY 2017 and in each year thereafter. There will be no fiscal impact on county or local expenditures or revenue.

METHODOLOGY:

The Department states there are currently 1,326 certified solid waste operators and 1,000, or 75% of the operators, are not full-time. The Department also states certification is the responsibility of the individual operator and not the employer. The Department assumes the following:

• The number of solid waste operators will remain level through the year 2020.

• The change in the certification requirement would be effective July 1, 2016.

• The 40 hours worked would be work at a solid waste facility and not in other employer activities.

• There would be no changes in staff costs to the Department since the Training Coordinator would still need to certify, develop, and deliver training for the full-time operators. Staff that has been helping with operator training and certification would spend more time on their non-training work responsibilities.

• Fee revenue from certifications would decrease by $50,000. (1,000 part-time operators X $50 annual fee for certification)

• The fee revenue is deposited in the Department's publications account and absent additional funds from some other source, annual expenditures from this account would decrease by $50,000.
