STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Sixteen

AN ACT relative to the implementation of the clean power state implementation plan.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Development of State Implementation Plan Prohibited. Amend RSA 125-C by inserting after section 6-a the following new section:

125-C:6-b Development of State Implementation Plan Under the Clean Air Act Prohibited.

I. The department is hereby prohibited from expending funds to develop or implement a state implementation plan for existing power plants as required by section 111(d) of the Clean Air Act until the final Environmental Protection Agency rule is declared constitutional.

II. The commissioner shall contract with an independent entity to review any plan to determine its economic effect on the state.

2 Effective Date. This act shall take effect 60 days after its passage.
