STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT relative to minimum housing standards for tenants with health or respiratory issues.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Minimum Housing Standards; Tenant with Health or Respiratory Issues. Amend RSA 48-A:14 by inserting after paragraph XI the following new paragraph:
XII. The premises does not have a cooling unit that is properly installed, safely maintained, and in good working condition, or not capable of safely and adequately cooling all habitable rooms, for tenants with respiratory or other health-related issues requiring an air conditioner. Pursuant to this paragraph, a tenant may request, notwithstanding any policy or practice to the contrary, that the landlord leave the air conditioner in the tenant's apartment or unit.
2 Effective Date. This act shall take effect January 1, 2017.
