SENATE BILL 538

AN ACT relative to children taken into custody under the child protection act and relative to the commission to review child abuse fatalities.


ANALYSIS

This bill:

I. Extends the time period within which a hearing must be held regarding a child taken into protective custody under RSA 169-C and requires the police to notify the department of health and human services of the hearing.

II. Extends the commission to review child abuse fatalities to June 30, 2017.

The bill is a request of the commission to review child abuse fatalities, established in 2015, 127.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Sixteen

AN ACT relative to children taken into custody under the child protection act and relative to the commission to review child abuse fatalities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

201:1 Protective Custody; Hearing. Amend RSA 169-C:6, IV to read as follows:

IV. The court shall hold a hearing on the matter within [24] 48 hours of taking the child into protective custody, Saturdays, Sundays, and holidays excluded. Notice shall be given by the police to both parents, the department, and all parties designated by the petitioner or the court.

201:2 Commission to Review Child Abuse Fatalities; Repeal Date Extended. Amend 2015, 127:6, II to read as follows:

II. Section 5 of this act shall take effect June 30, [2016] 2017.

201:3 Effective Date.

I. Section 1 of this act shall take effect 60 days after its passage.

II. The remainder of this act shall take effect upon its passage.
