AN ACT relative to the practices of pharmacy benefit managers.


AMENDED ANALYSIS

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seventeen

AN ACT relative to the practices of pharmacy benefit managers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

223:1 New Subparagraph; Managed Care Law; Provider Contracts; Pharmacy Benefit Managers. Amend RSA 420-J:8, XV by inserting after subparagraph (b) the following new subparagraph:

(c) A pharmacy benefit manager shall not require accreditation, credentialing, or licensing of providers other than by the New Hampshire pharmacy board or other state or federal entity.

223:2 Repeal. RSA 420-J:8, XV(c), prohibiting pharmacy benefit managers to require providers to obtain certain accreditation, credentialing, or licensing, is repealed.

223:3 Effective Date.

I. Section 2 of this act shall take effect May 1, 2018.

II. The remainder of this act shall take effect upon its passage.
