HOUSE BILL 1475

AN ACT relative to the procedure for filing a protective order.


ANALYSIS

This bill permits a parent or guardian to file a petition for a protective order on behalf of a minor. The bill also permits a guardian to file a petition for a protective order on behalf of his or her ward.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eighteen

AN ACT relative to the procedure for filing a protective order.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Name of Act. This act shall be known as Jade's law.

2 Protection of Persons from Domestic Violence; Petition Filed on Behalf of a Minor. RSA 173-B:3, II is repealed and reenacted to read as follows:

II.(a) A parent, guardian, or another representative may file a petition for a protective order on behalf of a minor, alleging abuse of the minor by a member of the minor's family or household. Any order issued under this chapter may be in addition to an order issued under RSA 169-C and any proceeding initiated under this chapter may be consolidated with a proceeding under RSA 169-C.

(b) Any minor plaintiff who seeks a protective order against a present or former intimate partner, spouse, or ex-spouse under this chapter need not be accompanied by a parent or guardian to receive relief or services under this chapter.

3 New Paragraph; Protection of Persons from Domestic Violence; Petition Filed by Guardian.

II-a. A guardian may file a petition for a protective order on behalf of his or her ward, alleging abuse of the ward by a member of the ward's family or household.

4 Effective Date. This act shall take effect January 1, 2019.
