AN ACT relative to licensing requirements for barbers, cosmetologists, estheticians, and licensed nursing assistants.
ANALYSIS
This bill limits the types of crimes for which barbers, cosmetologists, estheticians, and licensed nursing assistants are refused as applicants for licensure or are subjected to disciplinary action.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to licensing requirements for barbers, cosmetologists, estheticians, and licensed nursing assistants.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Barbering, Cosmetology, and Estheticians; Rulemaking; Applications. Amend RSA 313-A:8, XV to read as follows:
XV. The review criteria for board consideration of an applicant's "good professional character,'' provided such rules shall not prohibit an applicant from licensure for the conviction of a crime unless the applicant has been convicted of a violent crime as defined in RSA 651:5, XIII;
2 Barbering, Cosmetology, and Estheticians; Disciplinary Action; Violent Crime. Amend RSA 313-A:22, II(b) to read as follows:
(b) Conviction of a felony [or any offense involving moral turpitude] which is a violent crime as defined in RSA 651:5, XIII;
3 Nursing; Applicants for Licensed Nursing Assistant. Amend RSA 326-B:16, III to read as follows:
III. Report any pending criminal charges, criminal convictions, or plea arrangement in lieu of convictions; provided that for applicants for licensed nursing assistant, such reporting of charges, convictions, or plea arrangements shall be limited to violent crimes as defined in RSA 651:5, XIII and criminal neglect of elderly, disabled, or impaired adults under RSA 631:8.
4 Nursing; Disciplinary Action; Licensed Nursing Assistants. Amend RSA 326-B:37, II(c) to read as follows:
(c) Convictions by a court or any plea to a crime in any jurisdiction that relates adversely to the practice of nursing or to the ability to practice nursing; provided that for licensed nursing assistants, grounds for discipline shall be limited to charges, convictions, or plea arrangements for violent crimes as defined in RSA 651:5, XIII and criminal neglect of elderly, disabled, or impaired adults under RSA 631:8.
5 Effective Date. This act shall take effect 60 days after its passage.
