STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seventeen
AN ACT making oral contraceptives available without a prescription.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Pharmacies; Oral Contraceptives. Amend RSA 318 by inserting after section 47-j the following new section:
318:47-k Pharmacies; Oral Contraceptives.
I. Pharmacies, including mail-order pharmacies, may dispense oral contraceptives to persons 18 years of age or older without a prescription after an initial consultation with a licensed or certified health care provider. Such products shall only be dispensed by pharmacy employees, and shall not be accessible by the public without the assistance of a pharmacy employee. The package shall be labeled as follows: “WARNING: Use of oral contraceptives carries the risk of side effects. Consult your physician before use.”
II. In this section, “oral contraceptive” means medication taken by mouth for the purpose of birth control such as pills containing estrogen or progesterone.
2 Effective Date. This act shall take effect January 1, 2018.
