STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seventeen

AN ACT relative to fees for operation of a heating and agitation device in public waters.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Registration Required. Amend RSA 270:34 to read as follows:

270:34 Registration Required. Any person operating or hereinafter operating any such agitating or heating device which tends to inhibit the natural production of ice on public waters must obtain a registration per property to be designed and distributed by the department of safety, from the municipal clerk of the town in which such device shall be operated and said registration shall contain the name and address of owner and the location of said device. A [permanent] file of such registrations shall be kept by municipal clerks for one year after the expiration of the registration and a fee of [$.50] $5 per [registration] property may be charged.

2 Effective Date. This act shall take effect July 1, 2017.

METHODOLOGY:

This bill increases the fee for operating an agitating or heating device in public waters from 50 cents per registration to five dollars per property. This bill also changes the retention period for registrations from permanent to one year after expiration of the registration. The New Hampshire Municipal Association and Department of Safety state information regarding how many devices are currently used or the locations in which they are used is not known. This will result in an increase in municipal revenues to the extent a property owner registers such a device.
