STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eighteen

AN ACT enabling municipalities to establish term limits for elected officials.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Term Limits of Elected Officials. Amend RSA 49-C by inserting after section 34 the following new section:

49-C:35 Term Limits of Elected Officials.

I. A municipality may amend the charter under RSA 49-B:5 to include term limits for elected officials within the municipality. In no case shall the limitation of service:

(a) Be less than 2 consecutive terms.

(b) Restrict seeking other elected office.

(c) Restrict seeking the same elected office after being out of office for the time period required by the charter.

II. An at-large member may not serve on any seat on the same board within the time period prohibited by the charter.

2 New Section; Powers of a Municipality Under Charter. Amend RSA 49-D by inserting after section 5 the following new section:

49-D:6 Powers of a Municipality Under Charter. Unless specifically prohibited, a town operating under RSA 49-D shall be subject to the same rights and restrictions as authorized under RSA 49-C.

3 Effective Date. This act shall take effect 60 days after its passage.
