AN ACT relative to unused prescription drugs.

This bill authorizes police and fire stations to collect household medications from individuals which will then be transported by a carrier approved by the department of health and human services to disposal locations.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to unused prescription drugs.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Drug Take-Back at Police and Fire Stations. Amend RSA 318-E by inserting after section 1 the following new section:
318-E:2 Drug Take-Back at Police Stations and Fire Stations.
I. In this section:
(a) "Carrier" means an entity approved by the commissioner to transport unused household medications from police stations and fire stations.
(b) "Commissioner" means the commissioner of the department of health and human services.
(c) "Disposal location" means a site approved by the department of health and human services where unused household medications are destroyed in compliance with applicable laws so the household medications are in a non-retrievable state and cannot be diverted for illicit purposes. Communities may submit possible disposable locations to the commissioner for approval.
(d) "Household medications" mean controlled substances approved for collection by federal law, prescription drugs, and over-the-counter medications in the possession of an individual.
II. Police and fire stations shall collect household medications from individuals which shall be transported by carriers to approved disposal locations. This section shall not affect the operation of existing take-back and disposal programs. The commissioner may adopt rules pursuant to RSA 541-A relative to administering this section.
III. A police or fire station, carrier, or disposal location shall not be subject to liability for incidents arising from the collection, transport, or disposal of household medications if the police or fire station, carrier, or disposal location comply with this section in good faith and the police or fire station does not violate any applicable laws.
2 Effective Date. This act shall take effect 60 days after its passage.
