AN ACT relative to on-premises sales by liquor manufacturers.
ANALYSIS
This bill authorizes a liquor manufacturer to sell its product directly to customers at its separate on-premises licensed location without having to purchase the product from the liquor commission.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seventeen
AN ACT relative to on-premises sales by liquor manufacturers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Liquor Manufacturer; Reports and Fees. Amend RSA 178:6, VI to read as follows:
VI. Each liquor manufacturer shall maintain records and prepare reports for the commission which shall indicate the sales made under paragraph III, the sales made under paragraph XI of liquor not purchased from the commission, and samples distributed under paragraph IX and shall pay to the commission monthly a fee equal to 8 percent of such sales or 8 percent of the retail value of such samples on or before the tenth day of the month following the sale or the sample distribution.
2 New Paragraph; Liquor Manufacturer; Sales at Other Licensed Premises. Amend RSA 178:6 by inserting after paragraph X the following new paragraph:
XI. If the holder of a liquor manufacturer license also holds an on-premises license for other premises within the same city or town, the licensee may sell liquor manufactured by the licensee directly to customers at the on-premises licensed location without being subject to the purchase requirements of RSA 179:32.
3 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill would allow licensed liquor manufacturers to sell and serve unlimited amounts of spirit product on their premises and at other on-premises licensed locations in the same city or town. The Liquor Commission reports there are currently 11 liquor manufacturers licensed in New Hampshire. The Liquor Commission sold approximately 45,000 bottles of New Hampshire made spirits through state retail stores and roughly 6,300 bottles through on and off-premise licensees and agency stores during a twelve month period. The Liquor Commission earns approximately $6.47 in gross profit per bottle sold. The Liquor Commission states this bill will decrease the amount of New Hampshire made spirits it sells which would decrease liquor revenue. However, there is no data available to estimate the impact this bill would have on liquor revenue. Were the Liquor Commission to sell 1/3rd fewer New Hampshire made spirit bottles, then it would lose approximately $110,000 in gross profit (((45,000+6,000)/3)*$6.47 = $109,990).
