STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nineteen

AN ACT relative to animal waste cleanup in state forests and state parks.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Expansion of State Park System; Removal of Solid Animal Waste. Amend RSA 216-A by inserting after section 3-o the following new section:

216-A:3-p Removal of Solid Animal Waste. Any person who brings an animal into any parking, picnic, or camping area, or onto any road, walkway, or trail in a state park or state forest shall remove from such areas, roads, and trails all solid animal waste produced by such animal. Any person who violates this section shall be subject to a $50 fine. Appropriate signage may be posted as deemed necessary.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires any person who brings an animal into any state park or state forest property to remove all solid animal waste produced by such animal. Persons who violate this provision are subject to a $50 fine. Appropriate signage may be posted as deemed necessary.

The Department of Natural and Cultural Resources assumes responsibility for enforcement of this law pursuant to RSA 12-A:1-d. Any fee revenue would be credited to the State Park Fund pursuant to RSA 216-A:3-i or the Forest Protection Fund pursuant to RSA 227-G:5. The Department states it cannot estimate how many individuals will violate this provision or how much fine revenue would be collected, therefore the associated fine amount is indeterminable. The cost of creating, posting and maintaining such signage may be paid from the dedicated accounts, with a portion of the cost offset by collected fines. The number of signs needed and cost of maintaining such signage is indeterminable at this time.
